Version 2 · Last updated: 23 October 2026
This English version is provided for convenience. The binding version is the Portuguese one (Conditions for professionals); if the two differ, the Portuguese version prevails.
These conditions apply to anyone who provides services through the MimoSpot platform (mimospot.com and its apps) as a Professional. They complement the Terms and conditions and the Privacy policy. To register as a Professional, the service provider must accept them; the version and date of acceptance are recorded in their account.
Capitalised words have the meaning defined in the Terms and conditions. In particular: MimoSpot is the entity that operates the Platform; Professional is the independent service provider who accepts these conditions; Customer is whoever requests and books Services through the Platform.
1. The Professional is an independent service provider
- The Professional provides the Services in their own name, on their own account and at their own risk, as a self-employed person or company. The Professional is not an employee, collaborator, agent or representative of MimoSpot, and these conditions do not create any employment contract, partnership or mandate between the Professional and MimoSpot.
- The Professional freely decides whether to accept each Request, when they work, the Services they offer and the prices they charge. They have no set hours, no exclusivity and no minimum number of Services, and may work outside the Platform.
- The Professional uses their own equipment, tools and materials and organises the work as they see fit, respecting what was agreed with the Customer.
- MimoSpot is an intermediation platform: it connects the Professional with Customers and manages the Booking, the payment and the support. The contract for the Service is concluded between the Professional and the Customer.
2. Registration and verification
- To be approved, the Professional must confirm their email and send: identity document, proof of start of activity, proof of tax address and Portuguese criminal record certificate.
- Documents and information must be true, legible and valid. If any of them ceases to be valid, the Professional must send the new one before continuing to accept Bookings.
- Consent: by sending the identity document and the criminal record certificate, the Professional authorises MimoSpot to keep a copy only to check their identity and the absence of a criminal record incompatible with home services. These two documents are stored encrypted and deleted automatically 30 days after the profile is approved (or 30 days after the application is rejected). Only the record that they were checked, when and by whom, is kept.
- The photos the Professional sends (including photos of documents) are stored without metadata: MimoSpot automatically removes the GPS location, the date and time and the phone model. If the registration is rejected, all documents sent are deleted 30 days after the rejection.
- MimoSpot may approve or reject a registration, ask for additional documents and ask again for updated documents. False documents lead to rejection or immediate closure of the account.
3. Insurance
- Workplace accident insurance (mandatory): as a self-employed worker, the Professional is required by law to have workplace accident insurance (Decree-Law no. 159/99). The Professional is responsible for taking it out and keeping it valid while registered on the Platform. At registration, the Professional declares that they are aware of this obligation, and MimoSpot may ask for proof at any time. If the Professional is a company with employees, every person who carries out Services must be covered.
- Civil liability insurance: the Professional undertakes to have civil liability insurance covering damage caused to Customers or third parties during the Services, and specific insurance whenever the law requires it for their activity (for example, electrical or gas installations). MimoSpot may ask for proof at any time.
- MimoSpot does not take out insurance on the Professional's behalf and is not an insurer: the Professional's personal accidents and any damage they cause are covered by the Professional's insurance.
4. Liability
- The Professional is solely responsible for carrying out the Service, its quality, compliance with safety rules and any damage they cause to the Customer, the Customer's home or third parties.
- MimoSpot is not liable for accidents or injuries the Professional suffers while travelling or providing the Service, nor for damage to the Professional's equipment, unless caused by wilful misconduct or gross negligence of MimoSpot itself.
- If MimoSpot is required to pay compensation, a fine or a refund because of something attributable to the Professional (for example, damage caused during a Service or lack of insurance), the Professional undertakes to reimburse that amount to MimoSpot. MimoSpot may deduct it from amounts it has to transfer to the Professional, after informing them.
- MimoSpot's liability towards the Professional is limited to the functioning of the Platform and the transfer of the amounts owed to them, without prejudice to cases where the law does not allow limitation.
5. Tax and legal obligations
- The Professional must have their activity registered with the Tax Authority, issue the invoice or invoice-receipt for each Service to the Customer and meet their tax (income tax, VAT when applicable) and Social Security obligations. For this purpose, MimoSpot sends the Professional the Customer's billing details after the Service has been completed.
- Qualifications and certifications: the Professional takes full responsibility for meeting the legal and professional requirements for each job they carry out, including training, qualifications, certifications, licences and registration with the applicable professional bodies or regulators (for example, for electrical, gas or air-conditioning installations). The Professional may only offer and accept Services for which they are legally qualified and technically prepared.
- The check carried out by MimoSpot at registration covers identity, activity, tax address and criminal record. MimoSpot does not certify each Professional's technical qualifications, but may ask for proof at any time and remove from the Professional's profile the Services for which it is not provided.
6. Commission and payments
- The prices and travel fee the Professional sets are the final prices for the Customer, with VAT included if the Professional's activity is subject to VAT. Each Service has a fixed price and an expected duration (from 30 minutes to 8 hours), both set by the Professional. The Customer cannot change either of them. The Professional's calendar is blocked for the stated duration, plus a 30-minute margin between Services. The minimum amount for each Service is €20.
- MimoSpot charges the Professional a 20% commission on the total amount of each Service paid through the Platform, including travel. This commission decreases with the Professional's status (see the next point). Each Booking uses the commission in force when the Booking is made. The commission is invoiced by MimoSpot to the Professional monthly, and the invoices are available in the Professional's Earnings area.
- Bronze, Silver and Gold status. The status depends on the Professional's accumulated turnover on the Platform, i.e. the value of Services completed and paid through the Platform, including travel and minus refunds: Bronze from €1,000 (18% commission), Silver from €3,000 (16%) and Gold from €6,000 (14%). All turnover since the start counts, regardless of how long the Professional takes to reach each level. To keep the status, the Professional must have turnover of at least €1,000 in each 6-month period; otherwise, they drop one level (never more than one at a time) and move back up with another €1,000 of turnover. MimoSpot notifies the Professional one month before the end of each period. The status appears as a badge on the Professional's profile and in search and does not change the order of results. MimoSpot may temporarily grant a status (for example, in campaigns) and may review the levels and percentages with 30 days' notice, with no effect on Bookings already made.
- Payments are processed by Stripe. To be paid, the Professional must activate their Stripe payment account and comply with Stripe's conditions.
- The remaining amount (between 80% and 86%, depending on the Professional's status) is transferred to the Professional's account when the Customer confirms that the Service went well (or when the period for the Customer to report problems ends). If the Customer reports a problem, the amount is held by MimoSpot until the case is resolved. Stripe then sends the amount to the Professional's bank account, usually within a few business days, depending on Stripe's and the Professional's bank's timeframes.
- In the event of a cancellation or complaint, the refund rules in the Terms and conditions apply. If the Customer is refunded, the corresponding amount is not transferred to the Professional.
- The Professional may not ask for or accept payments outside the Platform for Services for Customers they met through it.
7. Bookings and conduct
- The Professional must reply to Requests within the stated deadline. An accepted Booking is a commitment: the Professional must arrive at the agreed time and let the Customer know through the Platform if they are running late.
- When they indicate they are on their way, the Professional may share their location so the Customer can follow them on the map. It is optional, only the Customer of that Booking sees it, and sharing stops when the Professional arrives or taps “Stop sharing”.
- When the Professional cancels an accepted Booking, the Customer receives a full refund and the Professional receives a warning on their account and, for 7 days, appears at the end of the search results. With 3 cancellations in 90 days, the Professional's account may be suspended.
- The Professional must treat Customers with respect and take care of the Customers' homes and belongings. Any abusive, discriminatory or harassing behaviour is not allowed.
- The Professional may only use Customers' data (name, address, contact and billing details) to provide the booked Service and issue the invoice. They may not keep it or use it for other purposes.
- Reviews follow the review rules. Asking for or offering anything in exchange for reviews is not allowed.
- The Professional may not provide Services under the influence of alcohol or substances that affect their ability and must comply with the health and safety rules applicable to each Service.
- 14-day guarantee. The Services the Professional provides through the Platform have a 14-day guarantee from completion, under the Terms and conditions. If the Customer reports a defect covered by the guarantee, or if MimoSpot concludes that the Service was not carried out properly, the Professional must come back to fix the work at no extra cost to the Customer, on a date agreed with the Customer and, unless otherwise agreed with them, within 7 days of the request. If the Professional does not do so, MimoSpot may refund the Customer or ask another Professional to fix the work and deduct that amount from the transfers it has to make to the Professional (see point 4). The guarantee does not cover materials or parts supplied by the Customer, nor those the Professional sells directly to the Customer, which follow the legal rules for the sale of goods.
How the search order is set
- Results only show approved Professionals who offer the requested Service and whose work area includes the Customer's address.
- The order is calculated automatically using these criteria, in this order of importance: 1) the distance to the Customer's address (in 1 km bands); 2) the MimoSpot ranking, which combines the average of Customers' reviews (weighted by the number of reviews), experience on the Platform (completed Services) and a penalty for cancellations made by the Professional; 3) the nearest available time slot.
- The Bronze, Silver, Gold and TOP badges do not change the order. It is not possible to pay to appear in a better position.
8. Suspension and termination
- The Professional may delete their account at any time in the professional area. Bookings already accepted must be fulfilled or cancelled through the Platform.
- MimoSpot may suspend or close the Professional's account in the event of false or expired documents, lack of mandatory insurance, breach of these conditions, fraud, payments outside the Platform, serious or repeated complaints, persistently negative reviews or repeated cancellations. Whenever possible, MimoSpot warns the Professional beforehand and explains the reason.
- Except in serious cases (for example, fraud, false documents, risk to Customers' safety or breach of the law), MimoSpot gives the Professional at least 30 days' notice before permanently closing the account. In any suspension or closure, MimoSpot explains the reason in writing, and the Professional may challenge the decision at profissionais@mimospot.com.
- Amounts already owed to the Professional for completed Services are transferred under the normal terms, unless there are complaints or amounts to be reimbursed to MimoSpot.
9. Data protection
How MimoSpot processes the Professional's data is described in the Privacy policy. For Customers' data that the Professional uses to invoice or to contact them on their own account outside the Platform, the Professional is the controller under the GDPR.
10. Final provisions
- MimoSpot may change these conditions. Important changes are communicated to the Professional at least 15 days in advance, by email or in their professional area. If they do not agree, the Professional may close the account before the changes take effect.
- If any clause is found to be invalid, the others remain in force.
- Complaints from Professionals: must be sent to profissionais@mimospot.com. MimoSpot reviews and replies within 15 business days at the latest.
- These conditions are governed by Portuguese law. For any question: profissionais@mimospot.com.
- Language. These conditions are written in Portuguese. Translations into other languages are provided for convenience only; if they differ, the Portuguese version prevails.
